Cancellation and refunds

Try before you pay

BaleineCash can be used free of charge for thirty days, with no sign-up and no means of payment. Thirty days with your own accounts, your own entries, on your own computer, with a program that is complete, unrestricted and subject to no condition.

We take the view that thirty days are enough to know what you are getting and what you are committing to.

At the end of the trial, as at the end of an annual licence, you have the choice:

• buy the product and get a licence that does not expire;
• take an annual licence, firm: you pay for a year, you use the product for a year, and nothing renews;

• subscribe for a year, renewing until you put an end to it;

• not carry on — that would make us sad, but we can understand it, especially if you tell us why. Your data stays available and exportable. Only the keying in of new entries is blocked.

If you buy the product, the program will never again need the internet to check your licence. A firm annual licence needs it no more than that: it carries its own end date, checked on the spot. Under a renewing subscription, by contrast, the program will try at the end of the period to fetch the next code; failing that, it blocks keying in.

What we control, and what we do not

That is our principle, and it is the one we try to keep alive with our official seller.

For technical and tax reasons, we cannot be the direct sellers of our own product: we go through an intermediary, Paddle Payments Ltd, who sells in its own name, invoices and accounts for VAT. We chose them because they are close to the way we see things, but they remain independent in their commercial and technical decisions, and we are in no position to impose our approach on them.

So be clear about this: the contract of purchase is one you enter into with them, not directly with BaleineCash. We grant you the licence; they take the money and issue the invoice. See The official seller.

What can be cancelled, and what cannot

The permanent licence is bought once and does not expire: there is nothing to cancel.

The firm annual licence stops of its own accord after twelve months: there is nothing to cancel there either, and nothing to keep an eye on. No payment follows.

The annual subscription, by contrast, renews. It can therefore be cancelled at any time for the following yearly period. The current period, however, cannot be broken off — neither technically nor contractually. It is the only one of our products that the paragraphs below on cancellation concern.

Fourteen days

If you buy as a consumer in the European Union, you have fourteen days from your order in which to withdraw, without having to give a reason.

That period runs from the order, regardless of the trial period that preceded it.

Why we ask for a waiver

Let us put it plainly. The withdrawal period would come on top of our thirty days of trial: thirty days to put the program to the test, then fourteen days more after the order. And if we gave you forty-five days of trial from the outset, the fourteen days would still run from the order.

We take the view that thirty days of real trial, with no card and no sign-up, protect a consumer better than fourteen days of withdrawal after payment.

There is a technical reason too. Our aim is a program that does not need the internet. Once your code is issued, it is not checked again — never for a permanent licence, twelve months later for an annual licence. That is the other side of a self-contained system: we can neither sell you a fraction of a year, nor stop a licence in mid-period, nor revoke it in the fourteen days following the transaction.

We therefore ask you to waive the withdrawal period, in exchange for immediate delivery. Think it over: you have had thirty days. If you refuse that waiver, we will not be able to complete the transaction.

Immediate delivery and waiver

Your licence code is digital content, delivered within the minute following payment, or in any case as soon as the official seller notifies us of the transaction.

At the time of the order, you are asked to confirm two things: that you want this immediate delivery, and that you understand you thereby lose your right of withdrawal once the code has been delivered.

Without that double confirmation, there is no transaction.

How to cancel the next subscription period

The subscription is cancelled online, on the official seller's site, at any time, without a reason and without writing to us.

A cancellation link is in the confirmation email they sent you, and in the licence management screen of the program.

What cancelling changes

It stops future payments. It cuts nothing off immediately: you keep full use of the program until the end of the period already paid for.

The current period is refunded neither in full nor pro rata. The program will simply not go looking for a code for the next period.

What remains afterwards

At expiry, only the keying in of new accounting entries stops. All the rest of the program stays available: consultation, statements, exports, printing, portfolio tracking. See What happens on expiry.

Your data stays on your disk, in readable files, independent of any licence. You lose nothing and you are never cut off from your own accounts.

Coming back later

A new licence, annual or permanent, reopens keying in on the existing accounts. There is nothing to rebuild.

The software does not work on your machine

Write to us before anything else: most blockages are settled in one exchange, and a defect reported to us is a defect we correct.

What we call a defect. A refrigerator that no longer makes cold has a defect. A refrigerator whose bulb has blown does not. BaleineCash has far more functions than a refrigerator: so it must be said which ones count.

The heart of the product is the keying in of accounting entries — it is the only function that the absence of a licence blocks, so it is the one you are paying for. See The heart of the product.

There is a defect where both of the following conditions are met:

• the keying in of accounting entries is prevented by a technical problem in the program;
• and we have not supplied a fix within the month following your report.

There is no defect where a supporting function stops doing its job: prices unavailable because an outside source has changed or closed down, a bank's export format altered, a statement or a chart that does not give what you had hoped for. Nor is there a defect where the program does not suit your hardware, your way of working or your expectations: the thirty days of trial are there to find that out before paying, without handing over anything and without having to ask us for anything at all.

What an established defect gives rise to. By way of exception to the above:

• for an annual licence, a refund of the current period, pro rata to the time left to run;
• for a permanent licence, a refund that takes account of how long the program has served, on a reference usage period of five years. A licence bought six months ago is refunded for the most part; a licence bought six years ago no longer is.

None of this takes away the rights the mandatory law of your country grants you, nor the statutory guarantee of conformity: see Statutory guarantee.

Who carries out the refund

The sale is made by the official seller, who takes the money and issues the invoice. It is therefore they who carry out the refund, to the original means of payment, generally within a few working days.
